The Problem with Joint or Combined Pattas
In Assam, when a patriarch passes away, the land is often mutated into the names of all heirs jointly. This creates a "Combined Patta". Selling a portion of a combined Patta is notoriously difficult as it requires NOCs from all co-pattadars.
What is Perfect Partition (Batwara)?
Batwara is the legal procedure administered by the Revenue Court to physically and legally divide the joint property, assigning independent Dag and Patta numbers to each heir based on their share.
How to Initiate Batwara
- If all co-heirs are in agreement (Amicable Partition), you can file a joint petition to the Circle Officer with a proposed subdivision map.
- The Lot Mandal verifies the boundaries and reports back.
- The BhuNaksha map is digitally split, and the Dharitree database registers new Pattas.
If there is a dispute amongst heirs, the matter must be taken up in the Revenue Court where the Circle Officer or Deputy Commissioner will adjudicate the boundaries.
